Can a minor get a tattoo with parental consent? State by state

A parent walks in with a 16-year-old and a note they wrote at home. Whether that note is worth anything depends entirely on the state you are standing in, and the answers sit further apart than most people expect.

Here is where all 50 states and the District of Columbia land. Every line came out of that state's own rule or statute, and the last column names it and links to the text. Each state name links to its page on this site, which carries the whole rule.

In all 51, 18 is the age a client can sign for themselves. What changes is whether anything below that is possible at all. 18 states say no: no form, no notary, no parent in the room changes it. 32 allow it with conditions. Hawaii is the one the rules record as a plain yes, on the written consent of a parent or legal guardian, kept on file in the shop.

6 of the 51 name a floor under 18: 16 in Arkansas, Florida, Kentucky, Tennessee and the District of Columbia, and 14 in Idaho. The rest that allow it name no floor at all, which is not the same as an open door. Your county can be stricter than your state, Baltimore City and Clark County both are, and plenty of shops set a house rule tighter than either.

What the consent record has to show

Where a minor can be tattooed at all, the paperwork is the whole permission. It comes down to 5 things.

Written consent, signed by a parent or legal guardian. Some states want it signed in front of you: Idaho has the parent sign in front of you or your employee, Michigan the same. Some want it notarized: Delaware, Kansas and Kentucky, and Florida, which puts it on the state's own form DH 4146.

The parent in the room. Arizona allows a tattoo under 18 only if the parent or legal guardian is physically present. Indiana wants presence and written permission, both, not either. Virginia is blunt about it: written consent alone is not enough.

Photo ID, often for both of them. Arkansas asks for government photo ID from the minor and the guardian. Florida has you inspect ID for both. New Jersey has you photocopy both into the client's application. Utah has the artist review and keep a copy of the parent's.

Proof they are the parent. Nebraska lists a birth certificate, adoption record, guardianship record or court document. Nevada wants a certified birth certificate or a court order granting custody. Michigan wants the minor's birth certificate or legal proof of guardianship.

And it stays in the file. West Virginia keeps the consent 5 years, Maryland 3, Hawaii 2, the same as the customer book. 18 of the 51 rules go further and name the parental consent as a field of the client record itself, so it is not a loose page that can wander off.

If your state allows it, capture all of that in the same record as the waiver, at the counter, while the parent is standing there. Every piece of it is easy to get in the moment and nearly impossible to get a year later.
